Effective Date: May 9, 2026

This Privacy Policy ("Policy") explains how Dispatch Direct LLC, operated by Jelena Radivojevic ("Company," "we," "our," or "us"), collects, uses, discloses, and protects the personal information of users ("you," "your," or "user") who access our website or use any related truck dispatching services ("Services"). This Policy applies to all users of the website.

By accessing this website or using our Services, you agree to the practices described in this Policy. If you do not agree with any part of this Policy, you must discontinue use of the website and Services immediately.

You are also encouraged to review our Terms and Conditions, which govern your use of the website and set forth additional terms applicable to our Services.

1. Information We Collect

We may collect personal and business information from you, including but not limited to your name, phone number, email address, company name, DOT and MC numbers, billing information, and business address. We may also collect operational preferences, location details, and any other information you voluntarily provide through forms, surveys, calls, or other interactions with us. Additionally, we may collect technical data about your interactions with the website — such as your IP address, general location (e.g., city and state), and browser data — for analytics and support purposes.

2. Methods of Collection

We collect information directly from you when you complete forms on our website, participate in surveys, or schedule calls. Information may also be collected through integrated systems, including:

Truk AI, which powers load matching and operational components of our Services, and receives load and carrier data necessary to perform dispatching functions.

GoHighLevel, which processes contact and communication data, including SMS and email interactions, on our behalf.

All data is collected with your knowledge and solely for the purposes described in this Policy.

3. Use of Information

We use the information we collect to provide and continuously improve our dispatching Services. This includes facilitating load matching, communicating with brokers and carriers, sending service updates, confirming appointments, issuing invoices, and processing payments. We may also use your data to deliver customer support, analyze performance metrics, comply with legal obligations, and send marketing or promotional communications where you have expressly provided prior written consent. Your data may be used for internal analytics to improve our business operations but will not be sold or used for any purpose not disclosed in this Policy.

4. Communication and SMS Messaging

Consent Requirement

We only send marketing or promotional SMS messages to individuals who have provided prior express written consent. This consent is collected through a dedicated opt-in form on our website or intake survey, which requires an affirmative action (such as checking an unchecked checkbox or submitting a consent form). Verbal agreement alone does not constitute valid consent for promotional text messages. Transactional and service-related messages (such as appointment reminders, load status updates, and service alerts) require express consent, which is obtained when you provide your phone number through our intake process.

Message Types and Frequency

Once you have consented, we may send you SMS messages that include appointment reminders, service-related alerts, dispatching updates, and promotional content. Message frequency may vary based on your service activity. Message and data rates may apply depending on your carrier plan.

Quiet Hours

We only send SMS messages between 8:00 AM and 9:00 PM in the recipient's local time zone, in accordance with applicable federal regulations. Recipients located in states with stricter quiet-hour requirements (including Florida, Oklahoma, Washington, and Texas) will receive messages only within those states' permitted hours.

Platform Registration

Our SMS messaging is conducted through a registered A2P (Application-to-Person) 10DLC campaign in compliance with carrier requirements. This registration ensures our messages are delivered reliably and in accordance with CTIA guidelines.

Opt-Out and Revocation

You may revoke your consent and opt out of SMS messages at any time by:

Replying "STOP" to any text message you receive from us

Sending an email to [email protected]

Calling us at (307) 414-7890

Any other reasonable written or verbal communication to us

We will honor all opt-out requests within ten (10) business days of receipt, regardless of the channel through which the request is made. After processing your opt-out, we may send one confirmation message to acknowledge the revocation. No further promotional messages will be sent after your request is honored. For assistance, reply "HELP" to any message.

Consent Not Required for Purchase

Your consent to receive SMS messages is not a condition of purchasing any product or service from us.

5. Legal Basis for Processing

We process personal information only when we have a legitimate reason to do so. Specifically, we process your data: (a) to fulfill services you have requested or contracted with us to provide; (b) with your express consent, where required by law; and (c) to comply with applicable legal obligations. We do not process your personal information for purposes beyond those disclosed in this Policy.

6. Sharing and Disclosure of Information

We do not sell or rent your personal information to third parties. We may, however, disclose your data to authorized third parties who assist in the delivery of our Services. These parties may include freight brokers, factoring companies, insurance providers, payment processors (such as Stripe), and technology platforms (such as Truk AI and GoHighLevel). Each of these recipients receives only the data necessary to perform their specific function:

Truk AI receives load and carrier data to support load matching and dispatching operations.

GoHighLevel receives contact and communication data to facilitate SMS, email, and scheduling functions.

Stripe receives billing information solely for payment processing purposes.

All third-party recipients are contractually obligated to use your information solely for the purpose of fulfilling their responsibilities in connection with our Services and to protect your data in accordance with applicable laws.

7. Cookies and Tracking Technologies

Our website may use cookies and similar tracking technologies to enhance user experience, measure website performance, and support marketing efforts. These technologies may collect information such as your browser type, IP address, device identifiers, pages visited, and referring websites. You may adjust your browser settings to refuse or disable cookies at any time; however, doing so may affect the functionality of certain website features.

8. Data Security and Storage

We implement commercially reasonable safeguards to protect your information from unauthorized access, disclosure, alteration, or destruction. Your data may be stored on secure servers managed by Truk AI and its underlying platform provider, GoHighLevel, both of which employ encryption and access controls consistent with industry standards. Access to your personal data is restricted to authorized personnel and partners, and is limited strictly to legitimate business purposes.

In the event of a data breach that affects your personal information, we will notify affected users as required by applicable federal and state law.

9. Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law. Consent records, including SMS opt-in documentation and opt-out requests, are retained for a minimum of four (4) years in accordance with the TCPA statute of limitations. When data is no longer needed, it is securely deleted or anonymized in a manner that prevents unauthorized access or use.

10. Your Rights

Subject to applicable law, you may have the right to:

Access the personal information we hold about you

Correct inaccurate or incomplete information

Request deletion of your data

Withdraw consent where processing is based on consent

Object to or restrict certain types of data processing

Opt out of promotional communications at any time

Residents of California, Virginia, Texas, and other states with specific privacy laws may have additional rights under applicable state law, including but not limited to the California Consumer Privacy Act (CCPA/CPRA) and Virginia's Consumer Data Protection Act (CDPA). To exercise any of these rights, please contact us at [email protected] or call (307) 414-7890. We will respond to your request in accordance with applicable legal requirements.

11. Children's Privacy

Our website and Services are not directed toward individuals under the age of 18. We do not knowingly collect personal data from minors. If we become aware that a user under 18 has submitted personal information without verifiable parental consent, we will take prompt steps to delete that data.

12. Changes to This Policy

We reserve the right to modify this Privacy Policy at any time. Any changes will be posted on this page with an updated effective date. If material changes are made to the way we handle personal data, we may notify you via email or through a prominent notice on our website. Your continued use of the website and Services following the posting of any updates constitutes your acceptance of the revised Policy.
